Ohio Interlock Device Guidelines

First OVI (operating a vehicle while impaired) offenders are not required by law to install an ignition interlock device. As of April 2017, Annie’s Law stipulates an increased license suspension for first-time offenders to a full year, but you may reduce that license suspension period by half if you agree to install an ignition interlock device in Ohio for at least six months.

For the second or subsequent OVI offenses within six years of your first offense, ignition interlock systems are mandatory in all vehicles you own and operate. If imposed by the court, you must obtain a specially marked driver’s license indicating that you may only operate vehicles outfitted with an ignition interlock device installed.

The court may also order the use of an ignition interlock device when using an occupational license for first and second offenses. Third and subsequent offenses mandate the use of IIDs and breathalyzers when using an occupational license.

Ohio DUI Penalties

Even if a court does not convict you of a DUI, you can still get an administrative license suspension (ALS), which occurs when you fail a breath test or refuse to take a breath test. An administrative license suspension can last anywhere from 90 days to five years depending on your blood alcohol content and driving record. You may also be able to regain limited driving privileges during your suspension, though there is a waiting period before you are eligible for these limited privileges. This waiting period can be 15 days to three years long.

A first-time DUI offense can result in jail time of three days to six months, a fine of up to $1,000, and a suspension period of up to three years. A second conviction requires a minimum of 10 days jail time, up to $1,500 in fines, a 5-year suspension, and a reinstatement fee of $450. Third and subsequent convictions may lead to up to a year of jail time, $10,000 in fines, and a three-year suspension. The court may even order a permanent suspension and a mandatory vehicle forfeiture.
