Criminal penalties for a DUI arrest in Minnesota depend on your blood alcohol content at the time of arrest, any minor passengers, and any potential injuries.
For a first offense
DUI with a BAC under 0.16 percent, you will be charged with a misdemeanor and may face up to 90 days in jail and/or a $1,000 fine.
If you refuse a chemical breath test or have a BAC over 0.16 percent
You will be charged with a gross misdemeanor and require up to a year in jail and/or a $3,000 fine.
Subsequent drunk driving offenses
Will result in higher fines, longer jail sentences, suspensions, and generally harsher penalties under the law.
Along with these criminal penalties, you may be subject to administrative penalties enforced by the state’s Department of Public Safety.

Ignition interlock devices may only be installed into your vehicle and serviced by court-approved vendors. You are also responsible for all installation and maintenance fees.
