Ignition Interlock Device Laws in Lancaster

Pennsylvania breaks down its DUIs into three separate tiers that are based on your blood alcohol concentration at the time of arrest. General impairment refers to a standard DUI with a BAC of 0.08 to 0.099. High BAC refers to a BAC of 0.10 to 0.159. The highest BAC tier comprises any BAC of 0.16 or higher or the use of a controlled substance.

The penalties for each tier become gradually more severe, even more so when factoring in multiple offenses. For a first offense general impairment DUI, you may be sentenced to:

  • Six months of probation
  • A fine of $300
  • Mandatory alcohol highway safety classes
  • Alcohol and drug evaluation and treatment

A first offense high BAC may result in:

  • A license suspension of up to a year
  • 48 hours to six months in prison
  • Fines ranging from $500 to $5,000
  • Mandatory alcohol highway safety classes
  • Alcohol and drug evaluation and treatment

For a first offense highest BAC, penalties may include:

  • A one-year license suspension
  • Up to six months in prison (a mandatory minimum of 72 hours)
  • Fines of $1,000 to $5,000
  • Mandatory alcohol highway safety classes
  • Alcohol and drug evaluation and treatment

For first offense high and highest BAC, you may qualify for an accelerated rehabilitative disposition program. Under this program, you will be required to attend twelve and a half hours of alcohol highway safety school and enroll in a drug and alcohol treatment program. You will still lose your license for up to 90 days, pay fines up to $5,000, and stay under court supervision, but the ARD may be beneficial to many.

All individuals in Pennsylvania are required to install an ignition interlock device after the second and subsequent offense, which includes all of the costs associated with its installation, maintenance, and monitoring.
