California has strict laws to deter drunk driving. Much like other states, California has adopted administrative or admin per se penalties that take effect if you either refuse or fail a breath test. These penalties are passed directly by the Department of Motor Vehicles and are separate from other criminal penalties that you may suffer from a DUI conviction.
Admin per se suspensions occur immediately at the time of arrest. The arresting officer confiscates your license and issues an order of suspension and sometimes a temporary license to let you get your affairs in order. The license and officer report are sent to the DMV, which makes the decision to suspend your license.
If you think the suspension is not justified, you can request a hearing within 10 days of receiving the suspension order. Admin per se penalties are generally harsher if you refuse to take a chemical test than if you simply failed the test. For refusing a test on your first DUI offense, you are subject to a one-year license suspension. Your second offense can lead to a two-year license revocation, while a third offense can result in a three-year revocation.
Along with admin per se penalties, you can suffer criminal penalties if you are tried in court or accept a plea agreement. For a first DUI offense, criminal penalties include:

- About $1,000 in fines, on top of other court fees
- $125 to reissue your license
- Enrollment in a DUI program
- Installation of an ignition interlock device
