Ignition Interlock Device Laws in Philadelphia

Pennsylvania has different penalty levels for DUI charges based on your blood alcohol concentration, but the highest penalties are often reserved for those who are driving under the influence of a controlled substance or refuse to take a chemical test. Courts can also add up to 150 hours of community service to any DUI charge. The three levels are:

  • General impairment (BAC of 0.08 percent to 0.099 percent)
  • High BAC (BAC of 0.1 percent to 0.159 percent)
  • Highest BAC (BAC of 0.16 percent and above)

The penalties get progressively more severe based on the offense and the level of your BAC. For a first offense general impairment, the penalties may include:

  • Six months probation
  • A fine of $300
  • Enrollment in an alcohol and drug treatment program
  • Mandatory alcohol highway safety school

Penalties for a first offense high BAC include:

  • One-year license suspension
  • Up to six months of jail time
  • Fines up to $5,000

For a highest BAC charge, first offense penalties can include:

  • One-year license suspension
  • Up to 6 months of jail time

First offenses for high and highest BAC also qualify for the accelerated rehabilitative disposition (ARD) program, which requires you to attend over 12 hours of class at Alcohol Highway Safety School and enroll in an alcohol and drug treatment program. This program can force you to lose your license for up to 90 days, stay under court supervision for 6 months, and include fines up to $5,000 (on top of all other fees).

Ignition interlock devices are required for second and subsequent offenses at any level. You are responsible for paying for the installation and all maintenance and monitoring fees.
