Ignition Interlock Device Laws in Price, Utah
Utah has strict DUI laws. If you drink and drive in Utah, you may be subject to two crimes: driving under the influence and driving over the limit. This is meant to deter driving with even a small amount of alcohol in your system. It also means that if your blood alcohol concentration exceeds 0.0.8 percent, you can be charged with two crimes.
If you are arrested for a DUI charge, you also suffer from administrative or per se penalties. Once you are arrested, the officer will immediately confiscate your license and replace it with a citation that expires in 29-days. Unless you submit a hearing request, your license will be suspended on the 30th day. The suspension period depends on your age, the number of prior arrests, and the results of any chemical tests.
For your first offense, the administrative suspension lasts up to 120 days, while a second offense can lead to up to two years of suspension. Generally, refusing to take a chemical test come with harsher penalties. If you are arrested for a DUI but refuse to take a test, you may suffer a suspension of up to 18 months. Second and subsequent offenses can lead to suspensions of 36 months.
It should be noted that administrative penalties are separate from criminal penalties you may suffer from a DUI. The criminal penalties for a DUI may include:
- Community service
- Jail time
- Various fines and court fees
- Participation in treatment programs for drug and alcohol abuse
- Installing an ignition interlock device in your vehicle
In Utah, you are required to install an ignition interlock device in any vehicles you own and operate for a DUI charge. If you are 21 or older, you are required to keep the ignition interlock installed for at least 18 months. Drivers under the age of 21 are required to have the IID for at least 3 years.
