Ignition Interlock Device Laws in Napa, CA

California has strict laws to deter drunk driving. Much like other states, California features administrative or admin per se laws, which are passed directly by the state’s Department of Motor Vehicles. Admin per se penalties occur when you either fail or refuse to take a chemical test.

The arresting officer immediately confiscates your license and issues a suspension order and a temporary license to get your affairs in order. The officer will then send your license and report to the DMV for review. During the review, the DMV will determine if your DUI deserves a suspension. You have the right to request a hearing within the first 10 days of the initial order of suspension.

The length of the suspension differs case by case, but generally, you will suffer a longer suspension for refusing to take a test than for outright failing a test. Refusing a test on your first DUI offense can result in a one-year license suspension. On your second offense, your license may be revoked for two years, while a third offense can lead to a three-year license revocation.
