San Diego Ignition Interlock Device Laws
In California, you can receive either an administrative suspension or a court-ordered suspension after being arrested for a DUI. In San Diego, the penalties differ based on the offense and whether or not you receive probation, but all levels are generally strict and severe.
For a first offense, the court will order you to enroll in an alcohol program. You must pay a penalty fee of up to $1,000 on top of mandatory penalty assessments. You may spend up to 6 months in jail along with a 6-month license suspension or have a restricted license that allows you to only drive to and from work and the DUI program. You are required to impound your vehicle for 6 months and install a car breathalyzer for up to 3 years.
For a second offense within 10 years, you must enroll in an alcohol program for 30 months and pay up to $1,000 in fines along with penalty assessments. You must serve a minimum of 96 hours to a full year in prison. Your license may be suspended for up to 2 years, and you are required to install an ignition interlock device for up to 3 years at the end of that suspension.
For a third offense within 10 years, you may spend a minimum of 120 days in jail. You must pay up to $1,000 in penalty fees, and the court may revoke your license for 3 years. You must also complete up to 30 months of an alcohol program if you did not complete one before.
Fourth or subsequent offense within 10 years come with many of the same penalties as a third offense, but the court can revoke your license for 4 years and you may be required to pay even more substantial fees.
The court regularly requires interlock ignition devices for DUI offenses, especially if you have prior DUI arrests or a high blood alcohol concentration.
